A
written statement details the main terms of the contract
between the employee and the employer. Failure to provide
a written statement to an employee within two months of
commencement of employment is a breach of The Employment
Rights Act 1996. Effected employees would have the right
to address this failure through the Employment Tribunal,
up to three months after termination of employment.
It is within the Tribunal's power to
impose the appropriate terms of employment on behalf
of the employer and back date them to the employee's
commencement of employment. Depending on the terms imposed
and the number of employees affected this could be an
extremely costly activity.
