Contracts & Policies

A key document that all employees must receive within two months of commencement of the start of their employment is a written statement, often known as a Contract of Employment, which details the main terms of the contract between them and their employer.

Failure to provide this document to an employee is a breach of The Employment Rights Act 1996, employees have the right to address any failure to supply this document through the Employment Tribunal, up to three months after termination of employment.

Failure to provide an employee with a written statement can result in the Tribunal awarding your employees a compensation award of between 1 and 4 weeks' pay.
Currently a week's pay is capped at £479. Even if only one employee brings a successful complaint the Tribunal can make the award to all employees who have not received a written statement and that can add up very quickly!
